Legal Responsibilities and Regulations
The Control of Asbestos Regulations 2012 is the main legal framework governing asbestos in the UK. These regulations place duties on employers, building owners, and workers to manage asbestos risk, including identification, risk assessment, control measures, and information provision.
Employers and building managers must:
- Identify whether asbestos is present in buildings or materials.
- Assess the risk of exposure to asbestos fibres.
- Develop and implement an asbestos management plan.
- Provide information, instruction, and training to staff and contractors.
- Ensure that only licensed professionals carry out high-risk asbestos work.
Employees have a legal responsibility to follow instructions, avoid disturbing asbestos-containing materials, report damage, and participate in training. Everyone must understand the importance of following safe practices and procedures to prevent exposure.
Failure to comply with asbestos regulations can result in severe legal consequences, including prosecution, fines, or imprisonment. More importantly, non-compliance can put workers’ health at risk, potentially resulting in life-threatening illnesses.
The regulations also distinguish between licensed work and non-licensed work. High-risk tasks such as removing asbestos insulation, sprayed coatings, or lagging require trained and licensed professionals. Lower-risk work, like minor maintenance where asbestos is unlikely to be disturbed, requires awareness and precautionary measures.
