HSE Counsel is committed to maintaining the highest standards of professional integrity and responsibility in all training, consultancy, and advisory activities. In certain circumstances, it may be necessary to disclose information provided by clients or learners to relevant authorities to protect public safety, prevent harm, or comply with legal obligations. This Disclosure for Public Safety Policy applies to all clients and learners, whether new or existing, and ensures transparency about the circumstances under which information may be shared.
HSE Counsel may disclose information where there is a reasonable belief that a serious or immediate risk exists to life, health, property, or the environment. Such disclosure may involve sharing relevant details with regulators, enforcement authorities, or other appropriate bodies. While HSE Counsel takes all reasonable steps to notify clients of any disclosure where practicable, urgent situations may require immediate action without prior notification to prevent harm. Clients and learners acknowledge that this policy is necessary to protect public interest and the wellbeing of individuals or organisations affected by potential hazards or unsafe practices.
The information disclosed will be limited to what is reasonably necessary to address the risk and will be handled in accordance with HSE Counsel’s Data Protection Policy. HSE Counsel will exercise professional judgement in assessing the level of risk, the parties to whom information is disclosed, and the appropriate scope of disclosure. Existing clients should also be aware that prior consultancy reports, training feedback, or ongoing engagement records may be considered in making disclosure decisions when there is a significant risk to safety or compliance.
By engaging HSE Counsel, clients and learners agree to cooperate fully and provide accurate and timely information. This policy ensures that HSE Counsel can meet its legal and ethical obligations while maintaining a safe and responsible service environment. It forms an integral part of the overall terms and conditions governing engagement and applies equally to new and existing clients across all services provided by HSE Counsel.
