Force Majeure Policy
HSE Counsel acknowledges that unforeseen events beyond its reasonable control may occasionally affect the delivery of training courses, consultancy services, or other engagements. Such events may include, but are not limited to, acts of God, severe weather, pandemics, industrial disputes, government actions, utility failures, or any other circumstances that prevent or delay the performance of contractual obligations. This Force Majeure Policy applies to all clients and learners, whether new or existing, and is intended to provide clarity and fairness in the management of such situations.
In the event that a force majeure occurrence impacts HSE Counsel’s ability to deliver services as scheduled, we will make reasonable efforts to notify clients and learners as soon as possible and provide alternative arrangements where feasible. This may include rescheduling training courses, remote delivery of sessions, or rearranging consultancy visits. While HSE Counsel will endeavour to minimise disruption, clients acknowledge that certain events are outside the company’s control, and flexibility may be required in terms of timing, location, or delivery method.
HSE Counsel shall not be held liable for any losses, damages, or costs incurred by clients or learners as a result of force majeure events, including any indirect or consequential losses. Fees already paid for affected services may be carried forward, refunded, or credited at HSE Counsel’s discretion, depending on the nature and impact of the event. Existing clients with repeat or ongoing engagements should note that any adjustments or rescheduling will be handled in the same manner as for new clients, ensuring consistency and fairness across all services.
By engaging HSE Counsel, clients and learners acknowledge that this Force Majeure Policy forms part of the contractual terms governing training, consultancy, and other services. HSE Counsel remains committed to maintaining high standards of service delivery while recognising that flexibility and cooperation are necessary when unforeseen circumstances occur. This policy ensures transparency and provides a clear framework for managing events outside HSE Counsel’s control while protecting the interests of both the company and its clients.
