All services, training courses, consultancy engagements, and contractual arrangements provided by HSE Counsel are governed by and construed in accordance with the laws of England and Wales. This Governing Law Policy applies to all clients and learners, whether new or existing, and provides clarity regarding the legal framework under which HSE Counsel operates, the resolution of disputes, and the enforceability of agreements. By engaging with HSE Counsel, clients acknowledge that these legal provisions form an integral part of the contractual relationship.

In the event of any disagreement, dispute, or claim arising from the provision of services, training, reports, or consultancy, both HSE Counsel and the client agree to seek resolution under the legal jurisdiction of England and Wales. This includes any disputes related to payment, service delivery, compliance, intellectual property, or third-party partner involvement. Where possible, HSE Counsel will seek to resolve disputes amicably and professionally; however, the ultimate recourse remains within the courts of England and Wales. Existing clients returning for additional services or follow-up training are equally subject to this legal framework, ensuring consistency and clarity across all engagements.

This policy also ensures that clients are aware that the contractual terms, policies, and agreements with HSE Counsel are interpreted in line with English and Welsh law, including applicable statutes, regulations, and case law. Any amendments or updates to terms, policies, or service agreements will continue to be governed by this legal framework, and clients are encouraged to familiarise themselves with their rights and obligations under these provisions.

By engaging HSE Counsel services, clients and learners agree that the governing law of England and Wales provides a clear, consistent, and enforceable basis for all aspects of service delivery, training, consultancy, and related activities. Where Does PUWER Apply?.

PUWER places duties on:

  • Employers – must ensure work equipment is suitable, maintained, inspected, and used safely.
  • Employees – must use equipment correctly and report faults or unsafe conditions.
  • Self-employed persons – must ensure any equipment they use is safe and suitable.
  • People in control of premises (e.g., landlords, contractors) – may also have responsibilities where they provide or manage equipment.
